Monetary compensation for employers according to Government Decree № 55 of 30.03.2020

Government Decree № 55 of 30.03.2020 of the Council of Ministers defines the conditions and procedure for payment of compensation to employers in order to preserve the employment of employees in the state of emergency, announced by a decision of the National Assembly of 13 March 2020.

As foreseen for a period not exceeding three months, the National Social Security Institute shall transfer 60 percent of the amount of the insurance income for January 2020 for persons insured under Art. 4, para. 1, item 1 of the Social Security Code, including working under employment contracts by insurers, meeting the criteria set out in the Government Decree.

Amounts as compensation will be paid to an employer who, because of a state of emergency, has terminated the work of the enterprise, part of the enterprise or individual employees.
Employers are explicitly required to maintain the employment of workers and employees for whom they have received compensation for a period not less than the period for which the compensation has been paid and not to terminate the employment contracts of employees on the grounds of Art. 328, para. 1, items 2, 3 and 4 of the Labor Code during the period for which they are compensated.

Employers submit an application to the Employment Agency, which serves the territory of the workplace of employees, to pay the compensation.
The National Social Security Institute pays compensation to employers, who meet the criteria.
